Terms of Service
Last updated April 2026
[LEGAL REVIEW REQUIRED] — These Terms are a working draft. Final terms will be reviewed by qualified legal counsel and published before public launch.
These Terms of Service govern your use of Stamped, a platform that enables verified payments and delivery of feature collaborations between independent artists. By using Stamped, you agree to these terms.
1. Platform overview
Stamped facilitates agreements between two artists for a paid musical feature or collaboration. We collect payment from the buyer (artist A), hold it pending delivery, and release funds to the seller (artist B) once delivery is confirmed or the confirmation window passes. Stamped acts solely as a payment intermediary and technology platform — we are not a party to the underlying artistic collaboration, and we do not hold or invest funds on behalf of either party.
2. Eligibility
You must be at least 18 years old to use Stamped. By creating an account you represent that all information you provide is accurate, current, and complete, and that you have the legal authority to enter into this agreement. Stamped reserves the right to terminate accounts where eligibility requirements are not met.
3. Accounts and authentication
Stamped uses magic-link (passwordless) authentication. You are responsible for maintaining exclusive access to your registered email account. Do not share your login link or session with any other person. Stamped is not liable for losses arising from unauthorised account access caused by your failure to keep your email account secure. Each person may maintain only one Stamped account.
4. Fees
Stamped charges a platform fee of 7% of the agreed deal amount (computed in integer cents: Math.round(amountCents × 7 / 100)). The remaining 93% is paid to the seller via Stripe Connect. All amounts are denominated in USD. The minimum deal size is $5.00 (500 cents). Fees are non-refundable except where a refund is issued due to verified non-delivery or identity fraud, in which case the full deal amount including the platform fee is returned to the buyer.
5. Payment flow
After the seller accepts the deal invitation, the buyer initiates payment. Funds are collected by Stripe on behalf of Stamped and held until either: (a) the buyer confirms delivery within 48 hours of submission, or (b) the 48-hour confirmation window expires, triggering automatic confirmation. In both cases, the seller's payout is released via Stripe Connect transfer. The buyer must initiate payment within the acceptance window or the deal expires automatically.
6. Delivery and disputes
Sellers have 14 days from the date payment is collected to submit the deliverable through the Stamped platform. Buyers have 48 hours after delivery submission to confirm or open a dispute. If no action is taken within 48 hours, delivery is automatically confirmed and funds are released to the seller. Dispute scope is strictly limited to verified non-delivery and identity fraud — Stamped does not adjudicate creative quality, artistic disagreements, or subjective outcome disputes. Stamped administrators will review disputed deals and issue a resolution (release to seller or refund to buyer) within a commercially reasonable timeframe.
7. Intellectual property
Artists retain full ownership of their creative work. By using Stamped, each artist grants Stamped a limited, non-exclusive, royalty-free license to display the stamp record (deal metadata, artist names, collaboration confirmation) publicly for the purpose of operating the platform and building a verified record of the collaboration. This license does not include the underlying audio files, stems, or any creative content.
8. Refunds and chargebacks
Refunds are issued only where an administrator determines non-delivery or identity fraud is verified. Quality-based refund requests are outside the scope of the platform. If a buyer initiates a payment chargeback through their bank or card issuer rather than opening a Stamped dispute, Stamped reserves the right to recover the funds from future payouts, suspend the account, and cooperate with Stripe's dispute process. Sellers whose accounts incur repeated chargebacks may be removed from the platform.
9. Prohibited conduct
You agree not to: (a) use Stamped for fraudulent, illegal, or copyright-infringing purposes; (b) circumvent the platform to avoid fees or dispute resolution (e.g., directing payments off-platform after a deal is initiated); (c) impersonate another artist or misrepresent your identity; (d) submit deliverables that are not your original work or for which you do not have the rights to transfer; (e) attempt to manipulate the dispute process through false claims; (f) use automated means to create deals or spam other users.
10. Termination
Stamped may suspend or terminate your account at any time for violation of these Terms, fraudulent activity, or for any other reason at our discretion with reasonable notice. You may close your account by contacting support. Termination does not affect any deals in progress — existing obligations survive termination. Financial records and stamp data are retained as required by applicable law and our data retention policies.
11. Disclaimers and limitations of liability
Stamped is provided "as is" without warranties of any kind, express or implied. We do not warrant that the platform will be uninterrupted, error-free, or free from viruses. To the maximum extent permitted by applicable law, Stamped's total liability to you for any claim arising from use of the platform is limited to the fees paid by you to Stamped in the three months preceding the claim. In no event shall Stamped be liable for indirect, incidental, consequential, or punitive damages.
12. Governing law
[PLACEHOLDER — LEGAL REVIEW REQUIRED] These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Stamped is incorporated, without regard to conflict of law principles. Any dispute arising under these Terms shall be subject to the exclusive jurisdiction of the courts of that jurisdiction.
13. Changes to these terms
We may update these Terms from time to time. We will notify you of material changes by email or through the platform. Continued use of Stamped after changes take effect constitutes acceptance of the revised Terms.
